This website is operated by Tensile Apparel LLC ("TENSILE", "we", "us", "our"), an Arizona limited liability company. By visiting tensileapparel.com, browsing, subscribing, or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy, and Return and Refund Policy, each of which is incorporated here by reference.

If you do not agree to these terms, please do not use this site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you meet that requirement and that the information you provide is accurate and complete.

2. Changes to these terms

We may update these terms at any time. The "Last updated" date above shows when. Changes apply to orders placed after they are posted. Your continued use of the site after a change means you accept the revised terms. Material changes will be reflected on this page rather than sent individually.

3. Products, colour and fit

Every TENSILE piece is produced on demand after you order. Because of this:

Product photographs and mockups are representative. Screens render colour differently, and garment-dyed fabric varies slightly between production runs. Minor colour variation is a characteristic of the product, not a defect.
Print placement is set within a normal manufacturing tolerance and may vary slightly between garments.
Measurements in the size guide are body measurements and are approximate. Garments are measured flat and may differ by up to the tolerance stated in the size guide.

We do not warrant that product descriptions, colours, or other content on the site are error-free. Where an error appears, we may correct it at any time without notice.

4. Pricing and payment

All prices are in US dollars and may change without notice. Applicable sales tax is calculated at checkout. Prices shown do not include any duties or taxes imposed outside the United States.

We reserve the right to correct pricing errors and to refuse, limit, or cancel any order, including after an order confirmation has been sent, in which case we will refund you in full. Reasons include suspected fraud, a pricing or description error, quantities that appear to be for resale, or inability to fulfil.

5. Orders, changes and cancellation

An order confirmation is an acknowledgement that we received your order. It is not acceptance. Acceptance occurs when the order enters production.

Because items are made to order, changes and cancellations are only possible before production begins. Email support@tensileapparel.com as soon as possible; we will accommodate requests where we can, but once production has started we cannot cancel or change an order.

6. Shipping, delivery and risk of loss

Production and delivery estimates are estimates, not guarantees. Orders containing more than one item may ship in more than one parcel at no additional cost to you.

Risk of loss passes to you on delivery. If a parcel is lost or damaged in transit, contact us and we will make it right. If a carrier records a delivery that you did not receive, we will work with you and the carrier in good faith, but we may require a signed statement or a police report before replacing an order.

We currently ship within the United States only.

7. Returns, exchanges and refunds

Governed by our Return and Refund Policy, which forms part of these terms. Nothing in these terms limits any right you have under applicable consumer protection law.

8. Intellectual property

The TENSILE name, logo, wordmark, product designs, photography, and site content are owned by Tensile Apparel LLC or used under licence, and are protected by copyright, trademark and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view and use the site for the purpose of shopping with us. You may not copy, reproduce, scrape, republish, or create derivative works from our content without our prior written permission.

9. Content you submit

If you submit a review, photograph, comment, or other content to us or about us, including through a reviews platform, social media tag, or email, you grant TENSILE a worldwide, non-exclusive, royalty-free, perpetual, transferable licence to use, reproduce, adapt, publish, and display that content in connection with our business, including in marketing, in any media, without further notice, attribution, or compensation.

You represent that you own or control the rights to what you submit, that it is accurate, and that it does not infringe anyone else's rights or violate any law. We may remove any submitted content at our discretion. We do not edit reviews to remove criticism.

10. Acceptable use

You agree not to use the site to break any law, infringe anyone's rights, transmit malware, scrape or harvest data, interfere with the site's operation or security, impersonate anyone, or attempt unauthorised access to any part of the site or any related system. We may terminate your access for any breach of this section.

11. Third-party services and links

Our site relies on third-party services including our ecommerce platform, payment processors, fulfilment partners, and analytics and advertising providers. The site may also link to third-party sites. We are not responsible for the content, policies, or practices of any third party, and linking does not imply endorsement.

12. Disclaimer of warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not warrant that the site will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TENSILE AND ITS MEMBERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM.

Nothing in these terms excludes liability for fraud, gross negligence, or anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Tensile Apparel LLC and its members, officers, employees and agents from any claim, demand, loss, liability or expense, including reasonable legal fees, arising out of your breach of these terms, your violation of any law, or your infringement of any third-party right.

15. Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Subject to Section 16, you and TENSILE agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

16. Dispute resolution: please read carefully

Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@tensileapparel.com and give us 30 days to resolve the issue. Most problems are solved at this stage.

BINDING ARBITRATION AND CLASS ACTION WAIVER. If we cannot resolve a dispute informally, you and TENSILE agree that any dispute arising out of or relating to these terms, the site, or any product will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.

YOU AND TENSILE AGREE THAT NEITHER MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION, AND THAT THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS. You may opt out of this arbitration agreement by emailing support@tensileapparel.com within 30 days of your first order; opting out does not affect any other part of these terms. Either party may still bring an individual claim in small claims court.

Time limit. Any claim must be brought within one year after it arises, to the extent permitted by law.

17. Electronic communications

By using the site or emailing us, you consent to receive communications from us electronically, and you agree that all agreements, notices and disclosures we provide electronically satisfy any legal requirement that they be in writing.

Marketing emails are sent only to people who have opted in, and every one contains an unsubscribe link. Unsubscribing from marketing does not stop transactional messages about your order.

18. Accessibility

We want the site to be usable by everyone and we work toward conformance with the Web Content Accessibility Guidelines. If you encounter a barrier, email support@tensileapparel.com and tell us what happened. We will help you complete your purchase and work to fix the underlying issue.

19. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, fire, epidemic, war, civil unrest, labour disputes, carrier or supplier failure, utility or internet outage, government action, or changes in tariffs or import rules.

20. General

Severability. If any provision is found unenforceable, the rest remains in force. Entire agreement. These terms, together with the policies referenced above, are the entire agreement between us and supersede any prior understanding. Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition, or sale of assets. Waiver. Our failure to enforce any provision is not a waiver of it. No third-party beneficiaries. These terms do not create rights for anyone other than you and us. Headings are for convenience only.
